Key Challenges

1. Standardization and Harmonization: Despite the efforts of AAOIFI, differences in the interpretation of Sharia norms still exist across different jurisdictions and legal schools globally. For instance, some products popular in Malaysia may not receive approval from Sharia boards in the Gulf countries. This lack of harmonization hinders the creation of a unified global market.

2. Form over Substance: Critics argue that some Islamic financial products merely replicate the structure of traditional instruments, replacing interest with a markup or rent, without changing their economic substance. This leads to accusations that the industry focuses more on the letter of the law rather than its spirit, which is about risk-sharing and social justice.

3. Lack of Qualified Personnel: The rapid growth of the industry has created a shortage of specialists who are knowledgeable in both modern finance and the intricacies of Sharia. Training such personnel is one of the most important tasks.

4. Weak Development of the Social Aspect: Islamic finance is often criticized for being too focused on commercial banking and not sufficiently developing tools aimed at combating poverty, such as microfinance (based on qard hasan) and effective management of zakat and awqaf.
